Ex-Nat'l Lampoon CEO to be sentenced in fraud case

INDIANAPOLIS (AP) ? A former chief executive of National Lampoon and two co-conspirators faced possible life sentences Friday after being convicted of swindling investors out of about $200 million.

U.S. District Judge Jane Magnus-Stinson was set to sentence Timothy Durham, James Cochran and Rick Snow following their June convictions on fraud and conspiracy charges.

A jury found each man guilty of securities fraud and conspiracy. It also convicted Durham, a major Indiana Republican Party donor who resigned his National Lampoon post in January, of 10 counts of wire fraud, while Cochran and Snow were convicted on some of those counts.

Prosecutors have said the three stripped Akron, Ohio-based Fair Finance of its assets and used the money to buy mansions, classic cars and other luxury items and to keep another Durham company afloat. The men were convicted of operating an elaborate Ponzi scheme to hide the company's depleted condition from regulators and investors, many of whom were elderly.

Durham's lawyers argued Friday that Fair Finance held assets of roughly $240 million at the time it was raided by the FBI in 2009, but that it lost that wealth because investors made a run on the company after federal prosecutors and the media portrayed the operation as a Ponzi scheme.

Prosecutors dismissed that argument, noting that investigators are still trying to find most of the money.

"Investors were endangered by this fraud, they were turned upside down by this fraud," said prosecutor Henry Van Dyck. "It's inconceivable any other kind of analysis could be applied to what happened to them."

U.S. Attorney Joe Hogsett has said none of the three has shown remorse for their crimes and each deserves the life sentence recommended in a probation report.

"Durham has earned a place among the greediest, most selfish and remorseless of criminals," Hogsett wrote in a sentencing memorandum earlier this week.

Attorneys for the defendants were hoping for shorter sentences.

John Tompkins, an attorney for Durham, has asked that the financier be sentenced to three years in prison and two years of home detention. Attorneys for Snow and Cochran also requested sentences lower than those recommended.

Snow's attorney, Jeffrey Baldwin, noted in a sentencing memo that former Enron Corp. CEO Jeffrey Skilling was sentenced to less than 25 years in prison after his convictions on 29 counts of fraud and conspiracy, while former WorldCom Inc. CEO Bernard Ebbers was sentenced to 25 years after being convicted of nine felonies including securities fraud in a loss of more than $1 billion.

The charges against Durham led several GOP politicians, including Indiana Gov. Mitch Daniels, to return hundreds of thousands of dollars in campaign contributions sought by Fair Finance's bankruptcy trustee.

Craig Skinner NCAA Media Opportunity

Nov. 28, 2012

LEXINGTON, Ky. - Opening statement ?

?We?re looking forward to playing in another NCAA Tournament this weekend. I?m proud and happy we?re being able to host. (I?m) Proud we?re the No. 16 seed in the tournament. I think our players are feeling pretty confident right now. (I) Feel good about what we?ve done the last few weeks, but we can throw all that out the window. When the tournament comes around it?s time to see who executes, and like Coach Cal (Calipari) said, who has the most fun and who competes the hardest to be able to win each and every match out. There are six total matches you can play, and we have to focus on East Tennessee on Friday night. Hopefully (we will be) successful, and if we are and get a chance to play the winner of Notre Dame and Ohio State. Also (I?m) pretty proud of our team and the conference awards we won. Having our libero (Stephanie Klefot) be Defensive Player of the Year in the league for the third-straight year is unprecedented in probably about any sport. Another First Team All-League player in Whitney Billings and Klefot second team also. Sara Schwarzwalder was All-Freshman Team. I think with the addition of teams in the league there were a lot of players who were left out across the league. We tried to get more recognition for some of the players in this conference, but it?s just the way it is. Again, proud about the weekend, looking forward to it, and can?t wait to see if we can get a huge crowd on Friday night.?

On the team?s preparation through the regular season schedule ?

?We?re definitely battle tested. We?ve seen about everything, we?ve seen top-five teams, we?ve seen SEC-caliber teams, we?ve won in five, we?ve lost in five, we?ve won in three and lost in three. There?s not an event or situation we haven?t been in, so I?d like to think that any situation we get into Friday night, we?ve been there before and understand how to handle it. I think so, but each rally is pretty significant and pretty important. I?m looking forward to seeing how our team responds to it.?

?

?

On how the team is playing right now ?

?We were awfully good our last three matches, especially being on the road around Thanksgiving, (with) a lot of distractions with the holiday, and family and stuff around. We came off a couple losses and strung together a few wins. I feel good about us. I feel good about our offense. Really like the way our team responded. I think they feel confident about what they?re doing right now, and that?s a good sign going into the tournament. It?s different pressure in the NCAA tournament. You see the logos, you see the brackets and you see all kinds of teams getting jacked up to play in the NCAA tournament. We will see, but I like this team and want to be with them heading into it.?

On the strength of the team going into the tournament ?

?Offensively our efficiency is pretty good. We aren?t making a whole lot of errors. Our floor defense has gotten better. We struggled with that in the middle of the year playing against some good teams with good outside hitters. I think we?ve done a good job of that the last few weeks, and that is very important because that is typically where matches are won and lost in the tournament, with big outside hitters. I think we?re serving pretty well. That?s another major factor in the NCAA tournament, can you serve and get teams outside their system so they can?t set all their options??

On the expected crowd ?

?Eight thousand? No, I don?t know. I think we got a good response already. Last year in the Regional there were over 4,000. Somewhere between that and our average attendance is 15th in the country between 1,500 and 2,000 a match. I think we?ll get a good crowd. The volleyball community here is really stepping up.?

HBT: B.J. Upton agrees to 5-year deal with Braves

UPDATE: Ken Rosenthal of FOXSports.com now says Upton is ?in agreement? with the Braves on a deal, pending a physical exam.

UPDATE #2: David O?Brien of the Atlanta Journal Constitution indicates that it?ll be a five- or six-year contract and says there probably won?t be an official announcement until tomorrow.

UPDATE #3: Bob Nightengale of USA Today reports that it?s a five-year deal worth at least $70 million.

UPDATE #4: Nothing is official yet, but it might as well be after Upton changed his Twitter avatar to the following:

source:

==========

?In serious talks? seems to be the buzz phrase of this offseason?see here and here, among others?and the latest usage is Jerry Crasnick of ESPN.com reporting that free agent center fielder B.J. Upton is ?in serious talks? with the Braves on a multi-year contract.

A few days ago reports had Upton looking to decide on his new team by the end of this week and the teams most often linked to him have been the Braves and Phillies.

Upton has posted some terrible on-base percentages in recent years, but he?s a very young free agent at 28 and combines 25-homer power with 40-steal speed and excellent range defensively in center field. With the Braves he?d be replacing Michael Bourn, who?s also a free agent after one-and-a-half seasons in Atlanta.

Wave of attacks in Iraq kills at least 39 people

BAGHDAD (AP) ? A wave of bombings targeting Shiite Muslims in two major cities south of Baghdad killed at least 39 people and wounded more than 100 on Thursday morning, Iraqi officials said.

The deadliest of the attacks was in the city of Hillah, where back-to-back explosions in a busy commercial area killed at least 27 people and wounded up to 90, a police officer said. Insurgents first detonated a roadside bomb that was followed by a car bomb explosion when rescuers rushed to the scene, he added.

Among the victims in Hillah, 95 kilometers (60 miles) south of Baghdad, were Shiite mourners who were commemorating the 17th century martyrdom of the Prophet Muhammad's grandson, Imam Hussein, he added.

Twisted and charred remains of vehicles were seen outside damaged shops as shop owners collected their strewn merchandise from the bloodstained pavement, littered with debris.

Just hours earlier, a parked car bomb went off at one of its gates of the city of Karbala in the nearby province by the same name, killing six people and wounding 20, another police officer said. The explosion took place less than one kilometer (half mile) away from the shrine of Imam Hussein.

Shiite religious ceremonies have often been targeted by Sunni militants who view the Shiites as heretics. Iraq has seen repeated deadly attacks against Shiites commemorating the anniversary of Imam Hussein's death, but Thursday's attacks were the deadliest since ceremonies started last Sunday.

Karbala, 90 kilometers (55 miles) south of Baghdad, is one of the holiest cities in Shiite Islam and the place where Imam Hussein and his brother, Imam Abbas, are buried. Hundreds of thousands of Shiites flock to their golden-domed shrines every year.

Also Thursday, a suicide bomber drove his explosives-laden car into a police checkpoint in the city of Fallujah, 65 kilometers (40 miles) to the west of the capital, killing three policemen and wounding 11 others, another police official said.

And in the northern city of Mosul, a parked car bomb went off next to a passing police patrol, killing two people and wounded two, police said. Another police patrol was hit by a roadside bomb in the in the town of Balad Ruz, 70 kilometers (45 miles) northeast of Baghdad, killing one policeman and wounding six others.

Three health officials confirmed the causality figures. All officials spoke on condition of anonymity because they were not authorized to talk to the media.

Although violence has ebbed since the peak of insurgency several years ago, attacks are still frequent against security forces, government officials and civilians. No one claimed responsibility for Thursday's bombings, but car bombs, shootings and roadside devices are the hallmark of al-Qaida in Iraq.

Power in a Pinch: GE Mobile Gas Turbines Improve Africa's Grid Reliability and Counter Rising Diesel Costs

Economies cannot thrive and grow for long without a reliable supply of power. That?s why GE designed its TM2500+ trailer-mounted aeroderivative gas turbines; the ecomagination-qualified units quickly generate reliable and efficient power anywhere, on or off the grid, while keeping emissions low.

In December, five of the TM2500+ units will add 120 megawatts of rapid and mobile power in Angola to counter the rising cost of diesel fuel and improve grid reliability. The TM2500+ is part of GE?s PowerXpand portfolio, which was unveiled earlier this year to help meet the growing need for rapid power generation throughout Africa and around the world.

?With a population of 19 million people but only a 26 percent electrification rate, Angola is a perfect example of how a country can use GE?s PowerXpand? Portfolio to provide greater long-term energy and economic security to residents and businesses alike,? said Darryl Wilson, president and CEO?aeroderivative gas turbines for GE Power & Water. ?Our TM2500+ and other products in our PowerXpand portfolio are ideally suited to help meet the demand for fast, mobile power in countries that are seeking more permanent energy and water infrastructure solutions.?

The fuel-flexible system runs on either natural gas or liquid-distillate and can be used to support permanent power installations, as backup power to support natural disaster relief efforts or for plant shutdowns and equipment maintenance.

The units are going to LS Energia (LSE) ? an engineering, procurement and construction company ? on behalf of the Angolan state utility Empresa Nacional Eectricidade-E.P. (ENE). This is GE?s third TM2500+ power project in Angola.

?GE?s TM2500+ systems offer the right combination of efficiency and reliability needed to help ENE reduce its fuel costs and increase the reliability of grid service in order to support continued economic growth in Angola. We are providing a complete solution from fuel supply to electricity on the grid. Our partnership with GE gives the customer a single point of contact,? said Nyembo Ilunga, President, LSE Africa.

GE?s PowerXpand? Portfolio features products designed to address both temporary and permanent power needs ?in a pinch?. Industrial businesses, developing communities and government agencies managing disaster relief all benefit from the portfolio, which includes GE aeroderivative gas turbines, Jenbacher and Waukesha gas engines and Clean Cycle waste heat recovery solutions.

FIFA, Brazil try to highlight healthy partnership

By TALES AZZONI

AP Sports Writer

Associated Press Sports

updated 10:25 a.m. ET Nov. 27, 2012

SAO PAULO (AP) - FIFA and Brazil World Cup organizers are trying to show unity in preparing the country to host the event in 2014.

FIFA is wrapping up an inspection tour of the host cities and will oversee the draw on Saturday for next year's Confederations Cup. There's also a board meeting of the local committee on Wednesday.

The activities come at a tumultuous time. Brazil is without a coach amid internal disputes at the federation. A local member of FIFA's executive committee was targeted in a police operation and some World Cup projects have been removed from the list of infrastructure work planned by the government.

Tighter deadlines are magnifying the challenges of getting Brazil ready for the Confederations Cup and 2014 World Cup. But FIFA and local organizers stress they are in sync.

"There's no problem with the relationship between FIFA and the LOC," FIFA Secretary General Jerome Valcke said. "We don't have a problem with the Brazilian government or with any of the 12 host cities. They are our representatives."

Soccer's governing body gave local organizers a big vote of confidence this month when it made an exception to approve the Confederations Cup with six host cities despite knowing that some stadiums won't be ready until just before the tournament in June.

"Two stadiums will be delivered in the middle of April, well behind schedule, though our technical team said everything was fine and we have to trust them," Valcke said. "The government has given its word the work will be finished and we have to believe people."

Valcke was responsible for igniting a controversy with the government this year after criticizing the country's preparations. FIFA President Sepp Blatter had to apologize after the government threatened not to deal with the secretary general.

But when Valcke was upset on Monday with the Rio de Janeiro government for announcing an exhibition at Maracana Stadium without FIFA's authorization, he was backed by Brazil's sports ministry.

Rio de Janeiro Gov. Sergio Cabral publicly announced that Brazil will face England to reopen the renovated stadium on June 2. However, Cabral didn't realize the stadium will be under FIFA's control from May 27 for the Confederations Cup.

"For the time being, we have not authorized the game," Valcke said on Monday.

The state said it will work with FIFA to try to gain permission.

Valcke said he was not worried about the police investigation of FIFA official Marco Polo del Nero, who was the vice president of the Brazilian federation and the president of the Sao Paulo state federation.

Police entered his home and checked information on his computers as part of a nationwide probe on the sale of confidential information and financial crimes. Thirty-three people were arrested, but Del Nero was only interrogated and denied any involvement. Police said the operation was not related to soccer, and Del Nero said he was questioned only because a company he hired for a personal business transaction was among those investigated.

Valcke called it an "internal" issue.

Del Nero was one of the top federation officials directly involved in the decision to fire coach Mano Menezes last week. The federation director who made the announcement, Andres Sanchez, said he was against the decision. Sanchez is expected to leave the entity this week, likely creating an opposing force to president Jose Maria Marin.

There is also turmoil in some of the host cities. The government in the capital of Brasilia this year removed an urban train project from the list of infrastructure work planned for the World Cup because it would not be ready in time. The same happened with a monorail project in the jungle city of Manaus.

Manaus also is considering changing its plans for the location of its Fan Fest venue because construction work may not be completed in time for the World Cup. FIFA had approved all the venues in April.

This week's forecast: Sunny with a 40 percent chance of flu

ScienceDaily (Nov. 26, 2012) ? New computer model takes a page from weather forecasting to predict regional peaks in influenza outbreaks

Scientists have developed a system to predict the timing and severity of seasonal influenza outbreaks that could one day help health officials and the general public better prepare for them. The system adapts techniques used in modern weather prediction to turn real-time, Web-based estimates of influenza infection into local forecasts of seasonal flu.

Results appear online in the Proceedings of the National Academy of Sciences.

Year to year, and region to region, there is huge variability in the peak of flu season, which, in temperate areas of the Northern Hemisphere, can happen as early as October or as late as April. The forecast system can provide "a window into what can happen week to week as flu prevalence rises and falls," says Jeffrey Shaman, PhD, an assistant professor of Environmental Health Sciences at Columbia University's Mailman School of Public Health.

As a test case, Dr. Shaman and Alicia Karspeck, PhD, of the National Center for Atmospheric Research, used Web-based estimates of flu-related sickness from the 2003-2008 influenza seasons in New York City to retrospectively generate weekly flu forecasts and found that the technique could predict the peak timing of the outbreak more than seven weeks in advance of the actual peak.

In the future, such flu forecasts might conceivably be disseminated on the local television news along with the weather report, says Dr. Shaman. Like the weather, flu conditions vary from region to region; Atlanta might peak weeks ahead of Anchorage. "Because we are all familiar with weather broadcasts, when we hear that there is a 80% chance of rain, we all have an intuitive sense of whether or not we should carry an umbrella," says Dr. Shaman. "I expect we will develop a similar comfort level and confidence in flu forecasts and develop an intuition of what we should do to protect ourselves in response to different forecast outcomes."

As individuals, a flu forecast could prompt us to get a vaccine, exercise care around people sneezing and coughing, and better tune in to how we feel. For health officials, it could inform decisions on how many vaccines and antiviral drugs to stockpile, and in the case of a virulent outbreak, whether other measures, like closing schools, is necessary.

"Flu forecasting has the potential to significantly improve our ability to prepare for and manage the seasonal flu outbreaks that strike each year," says Irene Eckstrand, PhD, of the National Institutes of Health's National Institute of General Medical Sciences, which provided funding for the study.

Worldwide, influenza kills an estimated 250,000 to 500,000 people each year; in the U.S. about 35,000 die from the flu every year.

The seed of the new study was planted four years ago in a conversation between the two researchers, in which Dr. Shaman expressed an interest in using models to forecast influenza. Dr. Karspeck "recommended incorporating some of the data assimilation techniques used in weather forecasting to build a skillful prediction system" remembers Dr. Shaman.

In weather forecasting real-time observational data are used to "nudge the model to conform with reality and reduce error in the model simulations," he explains. Applying this method to flu forecasting, the researchers used near-real-time data from Google Flu Trends, which estimates outbreaks based on the number of flu-related search queries in a given region.

Going forward, Dr. Shaman will test the model in other localities across the country using up-to-date data. This is necessary, he says, since "there is no guarantee that just because the method works in New York it will work in Miami."

Funding for the research was provided by the National Institutes of Health (grant numbers GM100467, GM088558 and ES009089) and the Department of Homeland Security.

S.Africa's Naspers turns again to China for growth

JOHANNESBURG (Reuters) - China's massive but increasingly competitive Internet market was the main driver of 15 percent first-half earnings growth for Naspers, prompting questions over how long the company can keep growing at such speed.

From its origins as a newspaper publisher in apartheid South Africa, Cape Town-based Naspers has morphed into a global multimedia business acquiring stakes in emerging-market Internet companies including China's Tencent.

Naspers' shares have risen over 50 percent this year, boosting its market capitalisation to $25 billion and making it more valuable than better known media firms such as Britain's Pearson Plc and Thomson Reuters.

But much of the growth has been driven by its 34 percent stake in Tencent, and some analysts say the company has become too reliant on China to fatten its bottom line - and too expensive.

"It's a wonderful business, very well run but you are effectively investing in Chinese internet stock Tencent by buying Naspers," said Nic Norman-Smith, chief investment officer at Lentus Asset Management in Johannesburg.

"We think that market is a little bit competitive and the barriers to entry for Internet companies are generally relatively quite low, so there is a chance that a big competitor comes out and puts Tencent under pressure."

Tencent contributed the vast majority of Naspers' earnings, delivering 2.99 billion rand of the total 4.1 billion rand of core headline earnings, or earnings before one-time items.

Naspers is trading at a price-to-earnings ratio of 70 times, the tenth most expensive stock among 220 global media companies tracked by Thomson Reuters.

However, some remain positive on Tencent.

"There are a lot of new growth initiatives that will probably play out in the next 12-24 months, be it in mobile, or advertising. Its coming pipeline is the strongest it has ever been in the history of Tencent," said one Johannesburg-based analyst who declined to be identified.

"(Naspers) can give you 30 percent growth for the next two to three years once you are out of the development spend cycle," he said.

DIVERSIFICATION

The company said it spent $530 million investing in new e-commerce businesses including Netretail, an on-line retailer with operations in Eastern Europe.

Management has in the past said it was finding fewer acquisition opportunities because valuations for new purchases were becoming expensive.

The company spent 45 percent more on development, rising to 1.6 billion rand in past six months and Chief Executive Koos Bekker said he would be spending a similar amount in the second half.

"We'll look at acquisitions and if it makes sense we may still buy companies, but the emphasis is more on organic growth now than it is on buying something," he told Reuters.

Naspers is rolling out infrastructure for digital terrestrial television that will make pay television affordable to even more people in Africa, where it is in 6 million homes.

Total revenue climbed 22 percent to 23 billion rand after Internet revenue rose 70 percent to 14.1 billion rand. The pay television segment grew 19 percent, contributing 14.4 billion rand to revenue.

Core headline earnings came in at 1,062 cents per share in the six months to end-September, up from 921 cents a year earlier.

It had flagged this month that underlying profit would rise by between 10 to 20 percent. Core headline profit, which Naspers says is its main earnings measure, excludes one-time items.

One-time items included a 1.5 billion rand profit from the sale of some Facebook shares by Russian affiliate Mail.ru. Naspers owns 29 percent in Mail.ru

Naspers' shares were down 0.4 percent to 538 rand at 1300 GMT, compared with a 0.18 percent rise by the Top-40 index.

According to Texas law, each injured person falls within a minimum coverage of $20,000 and up to $40,000 for all mixed up in accident, in addition to $15,000 valuation on property damage. In Texas, this form of coverage is dubbed ?20/40/15? coverage. However, many Texas drivers might find that basic coverage isn?t enough. Buy a lot more than the basic policy if you feel you?ll be held liable one day with an accident (poor display of confidence, yet needed!)

Many drivers opt for more coverage than is needed legally. It is because the minimal coverage usually is inadequate to really purchase expenses as a result of any sort of accident. Additionally, bodily injury and property damage coverage do not provide you with much protection yourself and your vehicle.

To acquire the excess protection yourself you would need to add additional coverage. Most insurance firms will suggest you no less than add coverage for underinsured/uninsured motorists. This coverage will pay for damages that occur if you are in an accident with somebody that doesn?t have insurance or would you not have enough insurance to pay the costs.

For those who have a lien on your vehicle then your lender will probably request you have much more coverage with collision and comprehensive coverage. Collision coverage can pay to correct or replace your vehicle which is damaged in an accident. Comprehensive will pay for damages that occur as a result of something other than any sort of accident.

With extra coverage you?re just ensuring that you and your vehicle are safe. Once the unexpected happens it can be rather costly, however with the best insurance coverage you are able to protect yourself from financial trouble.

Home Improvement: What To Understand Before You Begin ...

Most people hear the term ?home improvement? and right away reach for the Yellow Pages. Nevertheless it doesn't need to be as hard a role as you think. There are lots of do-it-yourself strategies to do-it-yourself. This article will provide you with a few creative tips for improving your home, without spending a lot.

Select satin paint in an area that may need constant cleaning. Satin paint has a beautiful glaze, and is appropriate for family room and children?s rooms, and the bathroom or kitchen, as it is really easy to clean. Keep in mind that touch-ups can be tough, as a difference in glaze would be plain.

If you are planning on painting a room as an element of a DIY project, you can save cash by precisely guessing the amount of paint you'll need. One gallon of paint will cover about 350 sq. feet of wall space, unless you are painting drywall, which absorbs more paint. A precise guess can stop you from overbuying paint, which once mixed in a particular color generally can?t be returned.

A great thing about interior decor is that oftentimes it doesn't need to match. You should buy a great dining room table and mix and match chairs. This is excellent for cottage and country-styled houses. Buying a table second hand and adding chairs from different places essentially creates a great design component, as well as a sense of achievement. Give those used chairs an opportunity to shine!

Always keep your working are clean when doing home enhancements. Many accidents happen when an area is disordered with debris and you cannot move and work correctly. Take some time from your project and clean the waste from the area. This will help protect you from trips, falls, and tangled cords.

If you are painting your home, be sure to clean off your brushes as fast as you've finished using them. Letting paint dry on the brushes can cause damage to the bristles and make them less effective. Additionally , if you fail to clean brushes totally and then move on to color another room, flecks of the first paint color may finish up in the new colour.

Never underestimate your home-improvement project. Before starting, jot down a list of the required steps that must definitely be followed, and have it reviewed by someone that is more informed than you to be certain there aren't any missing steps. Overestimate the time required to complete the project in case there are any unanticipated issues.

For a paint finish that really lasts, always sand, strip and prime, before trying a fresh coat. Many people think that skipping the preparatory steps of painting will accelerate the process , but down the line old paint will peel thru the new finish, spoiling your paint job and compelling you to strip off yet another layer of paint before repainting again.

In summary, home-improvement is less complicated now than ever. By employing the tips provided, you can be on your way to having the home you have always dreamed of. With a little bit of time, energy and creativity, you are sure to create the perfect look for your home. The best part is that you can reach it all for fragments of what you would pay a pro.

1 employee, 2 employers and health benefits: How many W-2s ...

Question: How do we report an employee?s health benefits if he transferred between two divisions of the same company, and each division has its own Employer Identification Number? Must each division report separately, or can we combine this information and report it on one W-2?

Answer: The IRS isn?t too choosy about this, since this reporting is for informational purposes only. As long as the employers are related, you can report the aggregate cost on one W-2 or split reporting between the benefits provided by each division. But whatever method you choose, use it to report health benefits for all employees who transferred between divisions this year.

DES MOINES, Iowa (AP) ? Black Friday shoppers in many cities briefly detoured into lottery retailers, drawn off task by the prospects of winning a $325 million Powerball jackpot ? the fourth-largest in the game's history.

Chicago resident Clyde Gadlin, 65, emerged from the bustle of holiday shoppers on Chicago's Michigan Avenue, to stop in at a 7-Eleven to buy his daily batch of Lottery tickets, including Powerball.

For him, the game is a chance to dream ? a single winner's cash payout would be nearly $213 million before taxes ? and he tries not to let the long odds burst his bubble.

Lottery officials say they're unsure what effect Thanksgiving and beginning of Christmas shopping season will have on sales, which normally pick up in the days before high-dollar drawings.

If Gadlin wins, he said he'd return to his grandfather's farm in Heidelberg, Miss., where he spent part of his childhood.

"I would go down there again and probably do a little bit of farming," he said, recalling the roaming deer and 380 acres of potatoes, corn, watermelons and sugar cane. Gadlin hasn't been there for more than 20 years.

And if he isn't successful this time, it's likely he'll have another shot at a record-breaking pot of cash.

Since Powerball tickets doubled in price to $2 in January, the number of tickets sold has decreased, but the sales revenue has made up for it, increasing by about 35 percent, said Norm Lingle, chairman of the Powerball board of directors.

And as the price went up, so did the jackpots, enticing thousands across the country to play.

"Christmas is coming and $325 million would come in handy," said Tim Abel, 63, who was buying a Powerball ticket at New York's Port Authority Bus Terminal. The Broadway stagehand said he usually plays whenever the jackpot goes over $100 million.

Recent Powerball winners include an Iowa couple that won a whopping $202 million on Sept. 26. A week later, a Delaware resident picked all six numbers for a $50 million payday.

Cashiers at a DeliMart convenience store in Iowa City said they expect a last-minute rush Saturday. The store sells $200 to $300 worth of Powerball tickets on an average day, but assistant manager Scott Falkenhan said he anticipates that will more than double.

Falkenhan, 32, was planning to buy his own ticket after his shift ended.

"I'd buy a new truck and a new boat," he said. "Then I'd go on my own fishing tour."

Roxie Breece, an assistant manager at a Cenex convenience store in Ogallala, Neb., said clerks have sold far more Powerball tickets than usual over the past week.

"Tomorrow's going to be a nightmare for us," she said. "With everybody out shopping and the drawing on Saturday, we'll be really busy."

Lingle, who is also the executive director of the South Dakota Lottery, says this weekend will be "telling."

"To my knowledge we've never had a large jackpot run like this fall over a major holiday," he said.

Frank Scorvino of Toms River, N.J., is in charge of buying lottery tickets ? including Powerball ? for a group of about a dozen fellow construction workers. If they win, he said, most of them would purchase new houses and cars, and some might go on a cruise.

South Bend, Ind., resident Dameon Smith says he'd retire from his job at the Hummer plant in Mishawaka, Ind. He said he'd share with family, friends and people he doesn't know.

Chad Robinson, 41, a chef at a Cleveland restaurant, had an option during his break Friday: Put down $2 on Powerball game or go next door to Ohio's first casino. He bet on the lottery, saying that much cash would change his life "drastically."

"I figure I'll make a lot of people happy with it, not just myself, spread the love and live my life out ? parents, loved ones, kids, co-workers, charities," he said.

Terry Fowler, 50, of Conneaut, Ohio, was visiting family in Tennessee for the holiday and stopped in a gas station in Brentwood on Friday morning to buy Powerball tickets. He's a regular player.

"I want to see more than one person hit it so they can share the wealth," said Fowler, a sales representative with a food service company. "I don't think any one person needs $325 million. If 7-10 people hit that, they will live like kings."

SIM-free Nexus 4 now available at Carphone Warehouse

Android Central

After a week or so of selling the phone on contract, UK retailer Carphone Warehouse has placed the LG Nexus 4 up for sale SIM-free, but with a hefty price tag. Carphone is selling the 16GB version of Google's latest Nexus for £389.95 outright, a price hike of more than £110 over the Google Play Store price for the same model. Of course, the crucial difference is that Carphone Warehouse actually has stock, whereas Google's own store is expected to be fresh out of Nexii for the next few weeks.

The £389.95 price tag sounds familiar, it's because it appeared in several pre-release leaks from the retailer, including website listings and in-store displays.

As always, CPW offers home delivery, as well as the option to reserve a phone to collect from your local store. It's also likely that the retailer will begin selling Nexus 4s at this price in its brick-and-mortar stores, though as it's outside business hours in the UK, we've been unable to confirm this.

So Brits now have an easy (though expensive) way to pick up a bona fide SIM-free Nexus 4 without signing a contract. Despite the price, it's an improvement on the situation in the U.S., where the phone is sold out on the Google Play Store and as of this morning, on T-Mobile USA's website too.

How Small Businesses Benefit from Online File Sharing | Training ...

As a small business owner, you may recognize the need to share files with clients, customers, associates and even employees. In the past, FTP has been the preferred method for sharing large files online. Because FTP transfers have been notoriously unreliable, small business owners must rely on other methods to share files and collaborate with colleagues; online file sharing services are quickly becoming the go-to method of storing and sharing information. Here are five benefits of online file sharing for the small business owner:

1.?????? Bounce-Backs are Eliminated

In the past, business owners utilizing FTP as a file sharing resource experienced high amounts of frustration. Transferring large files through FTP can take several minutes. Waiting for a file to send, only to be alerted a few seconds later that it was too large is a common occurrence. Online file sharing eliminates the instance of bounce-back to almost nil.

2.??????
Instant Sharing

Small business owners can share their files in a virtual instant with whomever they choose. Files can be shared via email attachment or weblink, whittling wait times to mere seconds. Instead of emailing large attachments over email, business owners can simply send a weblink to the persons of their choosing. Instead of having to wait hours to begin collaborations or discussions regarding business files, meetings can be conducted in real-time.

3.??????
Increased Security

Online file sharing sites feature security features not found on FTP networks. Users can password protect files, ensuring that only those who are granted permission can view the information. In fact, some sites are so secure that users won?t even know that files exist unless they are given a password by the owner of the file. This type of security can give business owners peace of mind in knowing that their confidential information is kept safe from prying eyes.

4.??????
Increased File Limits

Many FTP networks and email providers have a cap on file sizes. By utilizing online file sharing, business owners can often send single files up to 10 GB in size, rather than the typical 2 GB size limit set by email providers. This can be important for business owners who have large chunks of information to share, including videos and Power Point presentations.

5.??????
Cost-Effectiveness

Online file sharing sites are often incredibly cost-effective. Most sites offer a tiered program of pricing, allowing business owners to pay for the level of service that they need. Utilizing an FTP network to share files can cost small business owners much more money than online file sharing services because FTP networks require an actual server and properly trained staff. Many online file sharing sites also allow users to try their services for a month or more at no cost before being required to purchase a service plan.

Online file sharing services make sense for the small business owner. Increased security, a higher cap on file sizes and cost-effective pricing make online file sharing services the most sensible option. By simply sending a weblink, business owners can be assured that desired recipients will be able to view files quickly, which allows all parties to work more efficiently.

Health and safety for low risk businesses

Health and safety for low risk businesses

Health and safety for low risk businesses

Health and safety for low risk businesses

One of the direct consequences of the recent Lofsted Report that has now been approved is that ?low risk? businesses will be freed from health and safety routine inspections.

Regular inspections of businesses known to have breached legislation in the past will continue and any companies committing new legislation breaches will surely be added to the inspection hit list.

So what is considered to be a ?low risk? business and what safety obligations would such a business have?

A business considered to be ?Low risk? through the eyes of a health and safety officer would be shops, offices, pubs, restaurants and clubs. ?Here are some basic steps you need to think about in order to comply with safety law.

1) Appointing a responsible person. ? Depending on the size of your company, you would be able to deal with all health and safety issues yourself, appoint an employee who will be in charge of safety or may have an outside professional safety consultant. Bigger companies with more staff are more likely to need a health and safety advisor and smaller ones with only few employees may not. This all depends on the kind of industry you may be in and the level of understanding of health & safety regulations the appointed person has. ?A professional safety advisor would save you time and money whatever the size of your business especially if you schedule a consultation just once or twice per year.

Health and safety for low risk businesses

2)Your health and safety policy ? Is one of the basic requirements which the law contemplates. Every company in UK with more than five employees is obligated to have one. Essentially this is a written statement of all safety and health values and procedures your company is regulated by and committed to.? The policy should state very clearly who does what and how daily work is conducted safely for employees and anyone who may be affected by their work. You can write a policy yourself or hire a professional to do it for you. Have a look at our health and safety policy and risk assessment apps which are specifically designed to help you do it yourself.

3)Risk assessments ? are without doubt your most important tools for identifying hazards in the workplace to prevent harm and protect people. A written statement of every step that needs to be taken to prevent hazards would give you a better understanding of how serious and real these hazards are.? Usually a competent person or an experienced member of the staff in charge of the particular job should be appropriate to write the assessment.? This should also be correct person to give the best solutions to prevent risks.? Check and update your risk assessments every time you have a new employee, new equipment or change of environment. It is highly likely that a change of usual circumstances would eradicate some of the dangers while leading to new ones. Our risk assessment app is free and available for anyone to use here Risk Assessment Template.

4) Training? Everyone who works for you should know exactly what they are expected to do and how to do it. Training on how to work safely has to be conducted during working hours, as part of the general training for the job and is the companies obligation to keep all training records detailing what each? employee has been trained for.

5) First aid, ill-health and accidents ? To prevent work accidents and people being injured you need to consider what risks are present in your specific workplace and what first aid arrangements you need to make.? You should then appoint a first-aider. You also need to have available a first-aid box at the premises , and employees need to be informed what to do in case of dangerous of emergency situations.? Under current health and safety law certain injuries and work ? related diseases need to be kept on record and in certain cases reported.

Health and safety for low risk businesses

6) Welfare facilities, safety and health issues ? You need to provide minimal welfare facilities, according to the needs of your employees and the public.? Minimal requirements are toilets and basins (when necessary disabled facilities), changing rooms, usually required when employees are wearing uniforms, drinking water plus a place to rest and eat. Recently many companies are creating additional spaces for breastfeeding mothers and pregnant employees to rest, etc. ?The work area and environment needs to be healthy and comfortable , a good room temperature (at least 16C), good ventilation, suitable lighting, enough space, suitable seating and chairs, clean premises and enough rubbish bins. ?The most important safety issues would be easy access around corridors meaning access areas are kept clean, tidy and without obstruction.? Emergency routes need to have appropriately displayed signage. Make sure all fire extinguishers and basic first aid kits are also kept up to date.

7) Health and Safety Law Poster ? A valid and up to date version needs to be displayed so that any employee have easy access. You can also issue employees with the leaflet version of the poster if required.

We hope this quick guide will give you a better understanding and as always welcome any questions or feedback you may have

No blank cheque for Leveson, say leaders | The Times

Leaders of the three main political parties have told victims of press intrusion that they cannot give Lord Justice Leveson a ?blank cheque? on press regulation.

David Cameron, Ed Miliband and Nick Clegg held separate meetings with about 20 victims yesterday. Lord Justice Leveson?s report is expected to be published next week.

The meetings came as Michael Gove, the Education Secretary, took a swipe at Lord Justice Leveson.

Speaking at the Spectator?s Parliamentary Awards ceremony, Mr Gove referred to his own evidence before the Leveson inquiry, in which he mounted a strong defence of press freedom.

Man napping in field run over by combine, survives

BILLINGS, Mont. (AP) ? A man napping in a Montana cornfield was startled out of his snooze when he was run over by a large harvesting machine ? and Yellowstone County deputies say he's lucky to be alive.

Sheriff's Lt. Kent O'Donnell says the 57-year-old man had been traveling the country by bus and decided to take a rest three rows deep in a field on the outskirts of Billings, the state's largest city.

A farmer harvesting Wednesday felt his combine hit something. When he turned the machine off, he heard screaming.

Emergency responders found the man's clothing had been sucked into the cutter, ensnaring him in the blades.

O'Donnell says the man, whose name was not released, suffered cuts requiring stitches and may need skin grafts, but given the circumstances is "incredibly lucky."
